1. What these terms cover

These terms apply between you and Hesperan, owner Eduard Röhrig (see the imprint), when you use a Hesperan account for Hesperan Bots: signing in to the app, downloading the app and its updates, and downloading the system of the bots' computers, and your account page on hesperan.com.

You receive the app itself under the GNU Affero General Public License, version 3 only (AGPL-3.0-only), and the programs by others in it under their own licences (source code and licences). Nothing in these terms limits what those licences allow you to do.

2. Free of charge

Hesperan Bots, your account, the updates and the bot computer's system are free. We use your account data only to provide them (see the privacy policy), not as payment. Your AI provider may charge you under its own terms.

3. How the contract comes about

You enter your email address and ask for a sign-in link; you can correct the address before you send it. When you open the link (or sign in with GitHub, where offered), your account exists and you have accepted these terms. The contract language is English. We do not keep a separate copy of the contract for you; this page always shows the current version, and you can save or print it.

4. Your AI, your accounts, your instructions

Your bots work with the AI you choose (for example your ChatGPT or Claude plan, an API key or a local model) and with the websites, services and accounts you let them use. The terms of those providers apply between you and them, and you are responsible for following them and for what they charge.

Bots act on your instructions and within the permissions you set in the app. AI makes mistakes: check important results before you rely on them, and read an approval before you confirm it. Messages and actions a bot sends or performs for you go out in your name. If a bot writes to other people for you without you reading each message first, tell them they are dealing with an AI.

5. Fair use

Use your account yourself and keep your sign-in to yourself. Do not attack or overload hesperan.com, for example with automated mass downloads. If an account is misused, we may block it, after a warning unless the misuse is serious or a warning would not help.

6. Ending and changes

You can delete your account at any time in your account settings. Hesperan Bots needs a signed-in account: without one the app stays locked, does not get updates and cannot download the bot computer's system.

We may change or end the free account service for Hesperan Bots. We will tell you by email at least 30 days before we end it, unless security or the law requires us to act sooner.

7. Liability

Because Hesperan Bots and the account are free, we are liable, as the law provides for gifts and free loans, only for intent and gross negligence (§§ 521, 599 BGB), and for defects of the software and its content only if we fraudulently concealed them (§§ 523, 524, 600 BGB). This does not limit our liability for injury to life, body or health, under the Product Liability Act or under a guarantee we gave. Where the warranty disclaimer and liability limitation of the AGPL (sections 15 to 17) cannot take effect under German law, this section applies instead.

8. Applicable law

German law applies. If you are a consumer and live in another country, you also keep the protection of the mandatory consumer law of that country.
